1. Eligibility

• You must be at least 18 years old to use our Services.

• You must reside in or be physically located in a state where Evolve HealthCare and its licensed providers are

authorized to deliver telehealth services.

• By using our Services, you represent that the information you provide is accurate and complete.

2. Telehealth Services

• Evolve HealthCare provides weight management and related health services via telehealth, which may include video

visits, secure messaging, electronic prescriptions, and patient education.

• Our providers may prescribe FDA-approved medications or compounded alternatives for weight management when

medically appropriate.

• Telehealth has limitations, including the inability to perform certain physical examinations. In some cases, we may

recommend in-person evaluation or lab testing.

3. No Emergency Care

• Our Services are not intended for medical emergencies.

• If you experience a medical emergency, call 911 immediately.

• Evolve HealthCare does not provide urgent or emergency care services.

4. Patient Responsibilities

• Provide accurate and complete medical history, current medications, allergies, and health information.

• Follow treatment recommendations and instructions provided by your clinician.

• Use prescribed medications only as directed and not share them with others.

• Maintain a stable internet connection and secure environment for telehealth visits.

• Notify us of any adverse reactions, side effects, or concerns promptly.

5. Privacy and Security

• We maintain strict confidentiality of your personal and health information in accordance with HIPAA and applicable laws.

• Please review our Privacy Policy and Notice of Privacy Practices (NPP), which are incorporated into these Terms by reference.

6. Payment and Billing

• Services are provided on a self-pay basis unless otherwise specified. Insurance is not guaranteed to be accepted.

• You agree to pay all fees at the time of service or under the billing plan selected.

• Failure to pay may result in suspension or termination of Services.

7. Prescription Policy

• Prescriptions will only be issued when medically appropriate and determined by a licensed provider.

• We do not guarantee that you will receive a prescription, even after completing a consultation.

• Some medications may not be available in all states due to regulatory restrictions.

• Evolve HealthCare reserves the right to deny services or prescriptions if misuse, abuse, or diversion is suspected.

8. Risks of Telehealth

• By using our Services, you acknowledge and accept the risks of telehealth, including but not limited to:

• - Delays due to technology failures.

• - Limitations of not being evaluated in person.

• - Potential need for follow-up care or referral to another provider.

9. Prohibited Conduct

• Provide false information to obtain services or prescriptions.

• Use the Services for any unlawful purpose.

• Record or share telehealth visits without written consent.

• Harass, abuse, or threaten providers or staff.

10. Disclaimers

• Our Services are provided “as is” and “as available.”

• We do not guarantee weight loss results, outcomes, or success of treatment.

• Individual results may vary based on adherence to treatment plans, lifestyle changes, and biological factors.

11. Limitation of Liability

• To the maximum extent permitted by law, Evolve HealthCare and its providers are not liable for:

• - Indirect, incidental, or consequential damages.

• - Any delays, interruptions, or data loss resulting from telehealth platform use.

• - Outcomes that differ from patient expectations.

12. Termination

• We may suspend or terminate your access to Services at any time if:

• - You violate these Terms.

• - You misuse prescriptions or provide false information.

• - Required payments are not made.

• You may stop using our Services at any time by notifying us.

13. Governing Law

• These Terms are governed by the laws of the State of South Carolina without regard to conflict of law principles.

14. Changes to Terms

• We may update these Terms at any time.

• Updates will be posted on our website with a new effective date.

• Continued use of our Services after changes means you accept the revised Terms.
